MONA Cancellation and Refund Terms
1. Introduction
These Withdrawal and Return Conditions have been prepared by TKT Mimarlık Anonim Şirketi ("MONA") to inform you about your right of withdrawal, return process, and rights regarding damaged/defective products in your purchases made through www.monadek.com ("Website"). These conditions are regulated within the framework of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts dated 27.11.2014.
2. Product Categories
MONA offers products in two categories through the Website:
Catalog Products: Standard products fixedly listed on the Website, not customized by the Buyer. The right of withdrawal applies to these products.
Configurator Products (Custom Production): Products where the Buyer determines parameters such as size, module selection, and color using the MONA modular shelf configurator. Since these products are "goods prepared according to the consumer's specifications," they are outside the scope of the right of withdrawal.
3. Right of Withdrawal for Catalog Products
3.1 Withdrawal Period
For catalog products, the Buyer has the right to withdraw from the contract without giving any reason and without paying any penal clause within 14 (fourteen) days from the date of delivery of the product.
3.2 Exercising the Right of Withdrawal
A Buyer wishing to exercise the right of withdrawal must send a written notification to info@monadek.com within the 14-day period. The notification must include the following information:
- Order number
- Order date
- Product(s) to be returned
- Buyer's name, surname, and contact information
- Reason for return (not mandatory)
- Bank account information or card details for refund
3.3 Condition of the Product to be Returned
The product to be returned must be:
- Undamaged,
- Unused (not started assembly or disassembled if started),
- Complete with all parts (assembly hardware, screws, additional materials, user manual),
- Without any signs of use (scratches, stains, permanent assembly marks, etc.)
It is required. Preserving the original packaging is preferred; however, if the packaging has been discarded, the product can be returned re-packaged to protect against damage. Otherwise, MONA may not accept the return or may make a partial refund proportionate to the product's depreciation.
3.4 Return Process and Logistics
Since MONA products are large and heavy, the return shipping process differs from standard shipping:
- After the withdrawal notification, the Buyer is obliged to return the product within 14 days.
- Return shipping is organized through MONA's contracted logistics company; the Buyer does not need to find a shipping company or arrange transportation separately.
- Return shipping costs are borne by the Buyer and are deducted from the return amount before refunding. The estimated return shipping cost will be shared with the Buyer after the withdrawal notification.
- The product must be prepared for shipment to MONA, appropriately packaged (in its original packaging if preserved, otherwise wrapped with protective material against damage).
- After the product reaches MONA and its inspection is completed, the payment amount will be refunded through the channel the Buyer used for payment, less the return shipping cost.
- The return will be completed within a maximum of 14 days from the date of the withdrawal notification.
- For payments made by credit card, the reflection of the refunded amount in the card account after MONA's refund to the bank depends on the bank's processing time.
4. Exception to the Right of Withdrawal for Configurator Products
4.1 Legal Basis
Products where the Buyer determines parameters such as size, module selection, and color using the MONA modular shelf configurator are considered "goods prepared according to the consumer's wishes or explicit personal needs" in accordance with Article 15/1-(c) of the Regulation on Distance Contracts.
4.2 No Returns Possible
Therefore, return or withdrawal requests are not accepted for products designed and ordered through the configurator. As these products are custom-produced according to the Buyer's specific design, they cannot be sold to another customer or taken back for return.
4.3 Buyer's Information
The Buyer declares that before placing an order via the configurator, they were clearly informed about this situation, that the order summary and order confirmation indicated that the configurator product is custom-made and excluded from the right of withdrawal, and that by confirming the order, they accepted this situation.
4.4 Reserved Rights
Despite the above exception to the right of withdrawal, the Buyer's legal rights are reserved for defective/damaged products due to production or shipping. In such cases, Article 5 provisions apply. Furthermore, configurator products are also covered by a 2-year legal warranty; for warranty details, please refer to the Warranty Conditions document.
5. Defective or Damaged Product
5.1 Notification Period
If the product is delivered to the Buyer in a defective condition or damaged during shipping, the Buyer is obliged to send the following information to info@monadek.com within 7 (seven) days from the delivery date:
- Order number
- Description of damage/defect
- At least 3 (three) photos clearly showing the damage (exterior of the package, close-up of the defect, overall view of the product)
- If possible, the cargo damage report prepared at the time of delivery
5.2 Resolution Method
After reviewing the notification, if the defect is confirmed, MONA will, at the Buyer's preference:
- Replace the product free of charge with a new one,
- Repair the defective part (when possible),
- Refund the full product price

5.3 Responsibility for Detecting Shipping Damage
In cases of visible damage caused by shipping, the process of claiming rights becomes more difficult if a damage report is not drawn up with the cargo officer at the time of delivery. Therefore:
- Examine the outer packaging of the cargo package before taking delivery.
- If there are visible problems such as dents, tears, or water damage on the package, do not accept delivery without having a report drawn up with the cargo officer.
- Remember to report internal damages discovered after opening the package to MONA within 7 days.
5.4 Late Notification
MONA cannot be held responsible for defects and damages caused by the Buyer's failure to notify of a faulty/defective product within 7 days or by improper storage/use of the product.
6. Situations Where Returns Are Not Accepted
Returns are not accepted in the following cases:
- Custom-made products designed through the configurator (unless defective/damaged),
- Products that have been permanently assembled and cannot be returned to their original/re-packable state by disassembly,
- Damaged products resulting from the Buyer's fault (incorrect assembly, excessive screwing, dropping during transport, improper cleaning, or exceeding recommended load capacity, etc.),
- Free products sent as promotions or gifts,
- For manufacturing defects within the warranty period, warranty rights are used instead of withdrawal rights; the Warranty Conditions document applies to defective products.

8. Complaints and Objections
In case of objections regarding the withdrawal or return process, the Buyer may apply to the Consumer Arbitration Committees in their place of residence within the monetary limits determined annually by the T.R. Ministry of Trade, or to the Consumer Courts for disputes exceeding this limit.
