MONA Distance Sales Agreement

1. Parties

This Distance Sales Agreement ("Agreement") is established electronically between the parties whose information is provided below, and the parties have accepted and undertaken the rights and obligations specified in the Agreement.

1.2 Buyer

The Buyer is a real or legal person who places an order on the website named www.monadek.com ("Website"). The Buyer's contact and delivery information is specified during the order placement.

2. Subject of the Agreement

The subject of this Agreement is the regulation of the rights and obligations of the parties in accordance with the provisions of the Law on Consumer Protection No. 6502 ("Law"), the Regulation on Distance Contracts dated 27.11.2014 ("Regulation") and other relevant legislation, regarding the sale, delivery and other issues of the product/products (all together briefly "Product" or "Products") whose characteristics, quantities and sales price are specified below, which the Buyer ordered from the Seller's https://monadek.com e-commerce website ("Website").

For corporate Buyers (architectural offices, companies, commercial enterprises, etc.) who acquire goods or services for commercial purposes, and thus are not considered "consumers" within the scope of TKHK article 3/k definition, the provisions of this Agreement that are in favor of the consumer do not apply; for these Buyers, the provisions of the Turkish Code of Obligations and the Turkish Commercial Code apply, and the right of withdrawal, legal warranty periods against defects and other consumer rights are not valid.

The Preliminary Information Form on the Website and the invoice issued based on the order placed by the Buyer are an integral part of this Agreement.

3. Establishment and Entry into Force of the Agreement

3.1. The Buyer declares that by placing an order through MONA's website, they accept this Agreement electronically.

3.2. The Agreement becomes effective upon electronic approval by the Buyer and establishes its provisions between the parties.

4. Products, Price and Payment

4.1. The basic characteristics, sales price, payment method, and delivery conditions of the products subject to the order are specified in the order summary and payment screen of the Website.

4.2. MONA reserves the right to change prices. Price changes are not reflected to the Buyer after the order is confirmed.

4.3. Prices on the Website may be displayed in Turkish Lira (TRY) or Euro (EUR) depending on the user's location. For purchases made from Turkey, the invoice is issued in TRY.

4.4. Payments will be made using the payment methods offered by MONA on its Website. Card details are not stored by MONA.

4.5. The Buyer may earn discounts for one or more payments from category discounts or promotional codes defined by the Seller during product purchase.

4.6. Product images and measurements are for promotional purposes; minor color differences, surface texture variations due to production, and measurement tolerances (±3mm) within industry standards are not considered a breach of contract.

5. Delivery Conditions

5.1. Delivery is made to the address specified by the Buyer when creating the order. If the Product cannot be delivered due to reasons attributable to the Buyer, the Buyer will be informed of the situation. If the Buyer still does not accept the Product, the Seller will withdraw from the contract.

5.2. If the Buyer is not at the declared delivery address, the Buyer will be responsible for the additional shipping costs incurred due to the redelivery of the Products.

5.3. The delivery period is 7 (seven) to 14 (fourteen) business days from the order confirmation. Delivery is made up to the apartment door of the address specified by the Buyer. Indoor transport and assembly service may be offered for an additional fee, exclusively within the city limits of Istanbul. The delivery time may be longer for configurator products, depending on the production time. The maximum legal delivery period is 30 (thirty) days.

5.4. Shipping fee is separately stated in the order summary. Free shipping campaigns may apply for orders above certain amounts.

5.5. The Buyer is obliged to check that the ordered Product is delivered in accordance with the invoice/delivery note at the time of delivery. Damaged packages should not be accepted, and a report should be made with the cargo company official.

5.6. Since MONA products are large and heavy, delivery is made directly to the address specified by the Buyer; branch pick-up is not applicable for large-sized products. In cases where the product cannot be physically delivered to the address due to elevator width, stair access, or similar reasons, alternative solutions will be evaluated after informing the Buyer.

6. General Provisions

6.1. The Buyer declares that they have read and understood all conditions and explanations written in the Preliminary Information Form, which is located on the Website and is an integral part of this Agreement, regarding the basic characteristics, shipping, VAT, and any other additional costs, total sales price, payment method, and delivery of the Product subject to the Agreement.

6.2. From the moment the Buyer completes the order, the Seller ensures the delivery of the Product subject to the order within the period specified in Article 5.3.

6.3. If the Seller cannot fulfill its contractual obligations due to the impossibility of delivering the Products to the Buyer, it is obliged to notify the Buyer within 3 (three) days of learning of this situation and to refund all the amount collected from the Buyer within 14 (fourteen) days following this notification.

6.4. Confirmation of the Preliminary Information Form in electronic environment is essential for the delivery of the Products.

6.5. After the delivery of the Product, if the bank or financial institution does not pay the Product price to the Seller due to unauthorized use of the Buyer's credit card by unauthorized persons, not caused by the Buyer's fault, the Buyer must return the Product to the Seller within 3 (three) days.

6.6. The Seller is obliged to inform the Buyer if it cannot deliver the Products subject to the Agreement within the period due to force majeure.

7. Warranty

7.1. MONA products are covered by a warranty against defects for a period of 2 (two) years from the delivery date to the Buyer, in accordance with Article 56 of the Law on Consumer Protection No. 6502 and the provisions of the Warranty Certificate Regulation.

7.2. In case of defects covered by the warranty, the Buyer has the right to use one of the optional rights regulated in TKHK Article 11 (withdrawal from the contract, replacement with a non-defective equivalent, free repair, discount on the price in proportion to the defect).

7.3. Damages resulting from use contrary to the user manual, incorrect assembly, exceeding carrying capacity, impact/blow, unsuitable cleaning products, and unusual environmental conditions are excluded from the warranty.

7.4. In accordance with TKHK Article 58, MONA is obliged to provide spare parts for 10 (ten) years from the production date of the product.

7.5. For details on warranty conditions, please refer to the Warranty Conditions document published on the Website; this document is an integral part of this Agreement.

8. Right of Withdrawal

8.1 Catalog Products

For catalog products, the Buyer has the right to withdraw from the contract within 14 (fourteen) days from the date of receiving the Product, without giving any reason and without paying any penalty clause.

8.2 Configurator (Custom-Made Production) Products

Products whose parameters such as size, module selection, and color are determined by the Buyer using the MONA modular shelving configurator, are considered "goods prepared in accordance with the consumer's wishes or explicit personal needs" according to Article 15/1-(ç) of the Distance Contracts Regulation, and are excluded from the scope of the right of withdrawal.

8.3 Exercising the Right of Withdrawal

To exercise the right of withdrawal, it is sufficient to send a written notification to info@monadek.com within 14 days.

8.4 Condition of the Product to be Returned

The catalog product to be returned must be undamaged, unused, and all its parts complete. It is preferred that the original packaging is kept; however, if the packaging has been discarded, the product can be returned re-packaged to protect it from damage.

8.5 Return Process and Refund

Since MONA products are large, the return process differs from standard cargo:

  • After the withdrawal notification, the Buyer is obliged to return the product within 14 days.
  • Return shipping is organized through MONA's contracted logistics company.
  • The return shipping fee is borne by the Buyer and will be deducted from the refund amount.
  • The return is completed within 14 days at the latest from the date of the withdrawal notification.

8.6 Defective or Damaged Product

If the product is delivered to the Buyer in a defective or damaged condition during shipping, the Buyer is obliged to send a photographic notification to info@monadek.com within 7 (seven) days from the delivery date. In this case, the return shipping cost will be covered by the Seller.

9. Privacy, Information Security, Personal Data and Intellectual Property Rights

9.1. Necessary measures have been taken by MONA for the security of the information and transactions entered by the Buyer on MONA's website.

9.2. The Buyer can stop data usage-processing at any time by contacting MONA through the specified communication channels.

9.3. All intellectual and industrial property rights and ownership rights regarding any information and content on MONA's website and their arrangement belong to MONA.

9.4. MONA will keep and store the Preliminary Information and Agreement text in its systems for three years.

10. Force Majeure

10.1. Events that are not existing or unforeseen at the date of signing this agreement, and that develop beyond the reasonable control of the parties, are considered force majeure.

10.2. During the period of force majeure, the parties shall not be liable for their inability to fulfill their obligations under this agreement. If this period exceeds 30 (thirty) days, each party shall have the right to terminate the agreement.

11. Evidence Agreement and Authorized Court

11.1. In the resolution of all disputes that may arise from the Agreement and its implementation, Seller's records constitute conclusive evidence in the sense of HMK Article 193.

11.2. In disputes arising from this Agreement, the provisions of the Law on Consumer Protection No. 6502 will be taken as a basis. Consumer Arbitration Committees at the Provincial and District levels, within the monetary limits determined annually by the Ministry of Commerce as required by law, and Consumer Courts in cases exceeding these limits, are authorized.

12. Acceptance and Approval Text

The Buyer accepts and declares that they have read all the conditions and explanations on MONA's website, as well as in this Agreement and the Preliminary Information Form which forms an integral part thereof, that they accept their content, and that they accept the provisions of this Agreement with the order of the Product.

I have read the Distance Sales Agreement, I accept and approve its content.
