1. Data Controller

This Clarification Text has been prepared by TKT Mimarlık Anonim Şirketi ("TKT", "MONA" or "Company") as the data controller, in accordance with Article 10 of the Personal Data Protection Law No. 6698 ("KVKK") and the Communiqué on the Procedures and Principles to be Complied with in Fulfilling the Obligation to Inform.

2. Purpose of Processing Personal Data

Your collected personal data is processed for the following purposes, in accordance with the principles set forth in KVKK article 4 and the conditions regulated in articles 5 and 6:

  • Receiving, planning the production, invoicing, shipping, and tracking of orders placed through the Website
  • Recording your product designs made using configurator tools, processing them for production
  • Managing your return, exchange, warranty, and right of withdrawal requests
  • Meeting your customer service and technical support requests
  • Fulfilling our legal obligations (tax, commercial, consumer law, responding to public institution requests, etc.)
  • Delivering promotional, campaign, discount, and special offer notifications with your explicit consent
  • Improving the performance and user experience of the Website
  • Creating legal evidence in potential disputes and protecting our rights
  • Preventing fraud and deception, ensuring payment security

3. Categories of Personal Data Processed

The following categories of personal data are collected and processed:

  • Identity Information: Name, surname, company title and tax information for corporate buyers
  • Contact Information: Email address, phone number, delivery address, billing address
  • Customer Transaction Information: Order history, payment information (card information is stored by the payment institution, MONA does not store this information), designs created through the configurator, return/exchange requests, warranty requests
  • Marketing Information: Commercial electronic communication consent received with explicit consent, e-newsletter subscription
  • Technical Information: IP address, cookie records, browser information, session data, visited page records

4. Personal Data Collection Methods and Legal Basis

Your personal data is collected by the following methods and processed on the following legal grounds:

  • Necessity for the establishment and performance of a contract (KVKK Art. 5/2-c): Order taking, production, shipping, invoicing operations
  • Fulfillment of a legal obligation (KVKK Art. 5/2-ç): Requirements of tax legislation, consumer law, commercial law
  • Necessity for the establishment, exercise, or protection of a right (KVKK Art. 5/2-e): Return, warranty, legal dispute processes
  • Legitimate interest (KVKK Art. 5/2-f): Fraud prevention, system security, customer relationship management
  • Explicit consent (KVKK Art. 5/1): Marketing communications, profiling through cookies, e-newsletter subscription

5. Transfer of Personal Data

Your personal data may be shared with the following parties in accordance with KVKK Articles 8 and 9:

  • Shipping and logistics companies: Name, phone, address information for order delivery and return shipping
  • Payment institutions and banks: Payment information for processing payment transactions
  • Accounting, auditing, and legal service providers: Relevant information for fulfilling legal obligations
  • Web service and infrastructure providers: Information necessary for the technical operation of the Website (Shopify, Cloudinary, email services, etc.)
  • Authorized public institutions and organizations: Information upon legal request or due to a legal obligation

International Transfer: Our Website infrastructure provider Shopify (Canada), our visual infrastructure Cloudinary (USA), and some other technical services are located abroad. Data transfers made with these providers are carried out in accordance with the provisions of KVKK Article 9 and the data protection standards of the relevant providers.

6. Your Rights as a Personal Data Owner

In accordance with KVKK Article 11, you have the following rights regarding your personal data:

  • (a) To learn whether your personal data is processed,
  • (b) To request information if your personal data has been processed,
  • (c) To learn the purpose of processing and whether it is used in accordance with its purpose,
  • (ç) To know the third parties to whom personal data is transferred domestically or abroad,
  • (d) To request rectification if personal data is incomplete or incorrectly processed,
  • (e) To request the erasure or destruction of personal data within the framework of the conditions stipulated in KVKK Article 7,
  • (f) To request that the operations carried out in accordance with subparagraphs (d) and (e) be notified to third parties to whom personal data has been transferred,
  • (g) To object to the occurrence of a result against you by analyzing the processed data exclusively through automated systems,
  • (ğ) To demand compensation for damages if you suffer damage due to unlawful processing of personal data.

To exercise your rights, you can apply in writing to info@monadek.com. MONA will evaluate and conclude your request within 30 (thirty) days at the latest.

7. Data Retention Periods

Your personal data is stored for the period stipulated in the relevant legislation and for the period required by the processing purpose. At the end of the retention period, data is deleted, destroyed, or anonymized in accordance with KVKK Article 7 provisions. Example retention periods:

  • Order and invoice records: 10 years in accordance with the Tax Procedure Law
  • Contract and contractual communication: 10 years in accordance with the Turkish Code of Obligations
  • Commercial electronic communication consents and rejection notifications: 3 years in accordance with the relevant legislation
  • Customer support records: 3 years
  • Website log and cookie records: 2 years (or varies depending on the cookie type)

8. Update

This Clarification Text may be revised in parallel with legislative changes and updates in company policies. The current text is always published on the Website.
